PokerSharp is published by Your Custom Web Design Inc. ("we," "us," or "our"), an independent developer. Questions about these Terms may be directed to: support@ycwdesign.com
The App contains simulated poker content and is intended solely for users who are 18 years of age or older. By using the App, you represent and warrant that you are at least 18 years old. We reserve the right to terminate access for any user we have reason to believe does not meet this requirement.
PokerSharp is an educational training tool only. The App simulates poker scenarios for the sole purpose of teaching Game Theory Optimal (GTO) poker strategy.
The following apply without exception:
The free version of the App uses an in-app "chip" counter that meters how many training hands you can play. These chips are granted free (a starting balance, daily bonuses and optional rewarded ads), cannot be purchased with money, cannot be cashed out or transferred to another person or account, and have no monetary value whatsoever. If you sign in to a PokerSharp account, your chip balance is kept in your account rather than on the device (Section 10). They exist solely to pace the free experience.
Nothing in these Terms or within the App should be construed as an endorsement of real-money gambling, and we do not provide gambling services of any kind.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your personal, non-commercial purposes.
You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, disassemble, or decompile the App; (c) sublicense, sell, resell, or otherwise commercially exploit the App; (d) remove or alter any proprietary notices within the App; or (e) use the App for any unlawful purpose.
Sharing hands. As an exception to clause (a), you may share the hand cards, captions and share links that the App generates for hands you have played, for your personal, non-commercial use, such as posting them on social media or sending them in messages. You may not sell shared hands or use them in any commercial product or service.
The App, including its training content, GTO range data, software, design, graphics, and all other materials, is owned by or licensed to us and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you. The PokerSharp name, logo, and associated brand elements are proprietary to us. All rights not expressly granted in these Terms are reserved.
The PokerSharp logo may be used only as it appears on a hand card the App generates, unmodified; any other use of the logo requires our prior written consent. You may refer to PokerSharp by name when you share a hand or talk about the App.
You agree not to use the App in any manner that: (a) violates any applicable local, state, national, or international law or regulation; (b) infringes the rights of any third party; (c) attempts to gain unauthorized access to the App or its underlying systems; or (d) introduces malicious code or interferes with the proper functioning of the App.
Shared hands and display names. If you add a display name to a hand you share, it must not be offensive, hateful, obscene, or harassing, and must not impersonate any other person or organization. You are responsible for what you choose to share. We may remove any shared hand, or disable its link, at any time and for any reason, without notice.
App Stores. The App is distributed through third-party platforms including Google Play and the Apple App Store. Your use of those platforms is governed by their respective terms of service. We are not responsible for those platforms and have no control over their policies or availability.
Advertising. The free version of the App displays advertisements served by Google AdMob, a Google service. Use of the App while ads are present is subject to Google's Terms of Service and Privacy Policy insofar as they govern the AdMob software development kit embedded in the App. We do not control the specific ads that AdMob selects, the bidding network that fills inventory, or the destination of any link presented within an ad.
Rewarded ads. The App offers optional opt-in rewarded video ads in exchange for in-app chips (the free version's hand meter) or, in Ask the Coach, extra questions for that day. Participation in rewarded ads is voluntary. Chips granted by a rewarded ad apply to the device on which the ad was viewed or, if you are signed in, to your PokerSharp account, and confer no real-world value or transferable benefit.
Purchase validation. The App uses RevenueCat, a third-party purchase-management service, to validate purchases of PokerSharp Pro and track whether an installation is entitled to Pro (see Section 08 and our Privacy Policy).
Google Sign-In and Google Drive. Signing in to a PokerSharp account (Section 10) uses Google Sign-In, and the optional one-time import of a backup made by the App's former Google Drive feature reads that backup from your own Google Drive with your permission, and deletes the Drive copy afterwards only if you choose to. Your use of Google Sign-In and Google Drive is governed by your own agreement with Google, including Google's Terms of Service and Privacy Policy. We are not responsible for the availability of, or any loss of data within, your Google account or Google Drive, and you remain responsible for the security of your Google account. See our Privacy Policy for the full detail.
No endorsement. The presence of an advertisement within the App is not an endorsement by us of the advertiser, its products, or its services. We are not responsible for the content, claims, accuracy, or business practices of any third-party advertiser, and we are not party to any transaction you may enter into with an advertiser.
Ad-blocking and disablement. We reserve the right to detect, restrict, or terminate access to the App where ad-blocking, ad-spoofing, or other circumvention of the advertising functions is detected. The supported way to remove ads is the PokerSharp Pro purchase described in Section 08.
PokerSharp Pro is an optional, one-time purchase that removes advertising and the chip meter and unlocks additional study features. It is not a subscription: you pay once, it never renews, and there is nothing to cancel. It is billed entirely through your app store, and we never receive or store your payment details.
What Pro includes. PokerSharp Pro removes all advertising, removes the chip meter (unlimited training hands), and unlocks Pro-designated features such as X-Ray Replay, the Fold Skipper option and unlimited Ask the Coach questions for ordinary personal use (subject to the fair-use terms in Section 09). The exact feature set is described in the App at the point of purchase. Pro-designated features added in later updates of the App are included with your purchase at no additional charge.
Price and billing. Pro is sold as a single, non-recurring, non-consumable purchase. All payment is collected by Google Play or the Apple App Store under their terms; the current price, in your local currency, is always displayed in the App before you confirm a purchase. We never see your payment card or billing details.
Duration. Your Pro entitlement does not expire. It remains active for as long as we make the App available, subject to these Terms. Uninstalling the App does not remove the entitlement; reinstall and use "Restore purchases" to bring it back.
Price changes. We may change the price of Pro for new buyers at any time, including when launch pricing ends. A price change never affects a purchase you have already made, and you will never be charged again for Pro.
Refunds. Because billing is handled by the platforms, refunds are governed by Google Play's and Apple's refund policies and are requested through them. We cannot directly refund a platform-billed purchase, but if you run into trouble, contact us at support@ycwdesign.com and we will help you navigate the process.
Restoring purchases. Pro does not require a PokerSharp account. Your entitlement is tied to your store account: on a new device, use the "Restore purchases" option in the App (Settings → Manage purchase) while signed in to the same Google Play or App Store account. If you are signed in to a PokerSharp account, your purchase is also associated with that account so that Pro can follow you to other devices where you sign in. Deleting your PokerSharp account does not refund or remove a purchase made through your app store.
Closed beta. While the App is in closed testing, we may unlock Pro features for testers at no charge. Beta access is provided for evaluation and may be changed or withdrawn at any time; it does not create a paid entitlement.
Ask the Coach answers your questions with text written by an artificial intelligence model. AI answers can be incomplete or wrong, even when they sound confident. They are educational content only, not gambling, financial, or professional advice. Check them against the App's range charts and your own judgment before relying on them.
How it works. When you send a question, the question, a summary of the hand or statistics you are asking about, and the earlier turns of that conversation are sent through an endpoint we operate to a third-party AI provider that writes the reply on our behalf. The feature needs an internet connection, is available on Android at launch, and may be labelled as a beta. Our Privacy Policy describes what is kept, for how long, and how to have it deleted.
What you send. Ask about poker and the hands you play. Do not include personal information about yourself or anyone else in a question. You are responsible for the content you submit.
Daily limits and fair use. The free version includes a daily number of questions, shown in the App, and may offer a few extra questions for that day in exchange for watching an optional rewarded ad. For PokerSharp Pro, Ask the Coach is unlimited for ordinary personal use. To keep the service available for everyone, every installation, including Pro, is subject to a high daily fair-use ceiling and to rate limits, set so that normal personal use does not reach them. Unused questions do not carry over and have no monetary value.
Prohibited uses. You agree not to: (a) access Ask the Coach by automated or scripted means, or from anything other than an unmodified copy of the App; (b) attempt to bypass, reset, or exceed the daily limits, rate limits, or app-integrity checks; (c) extract answers or range data in bulk, or resell or republish them; or (d) attempt to make the coach produce content unrelated to poker training, or content that is unlawful, harmful, or abusive.
Monitoring and enforcement. We monitor how often the feature is used and may review conversations retained under our Privacy Policy, to check the quality of answers and to detect abuse. If we reasonably believe an installation is abusing Ask the Coach or breaking these Terms, we may limit, suspend, or block that installation's access to Ask the Coach. Doing so does not remove your Pro purchase or the App's other features.
Availability. Ask the Coach depends on third-party services and may be slow, interrupted, changed, or withdrawn at any time, as described in Section 16.
A PokerSharp account is optional: every training feature works without one. If you sign in, your hand history, settings, bankroll and chips are stored in your account on our servers so they follow you to other devices. Our Privacy Policy describes exactly what is stored, where, and for how long.
Creating an account. An account is created only by signing in with Google, either on the welcome screen the first time you open the App or later in Settings → Account. By signing in, you agree to these Terms and to our Privacy Policy. You must meet the age requirement in Section 02 and sign in with a Google account that belongs to you. An account is for one person: do not share it or sign in to someone else's.
Keeping your account secure. Your PokerSharp account is reached through your Google account, so anyone who can sign in to your Google account can reach your PokerSharp account. You are responsible for keeping your Google account secure. If you believe someone else has used your account, contact us at support@ycwdesign.com.
Limits. An account holds up to 100,000 hands; beyond that, new hands stay on your device only. Uploads and other account activity are subject to daily limits that keep the service available for everyone; when a limit is reached, syncing pauses and continues later. You agree not to bypass or attempt to bypass these limits, or to access the account service by any means other than an unmodified copy of the App.
Chips in your account. While you are signed in, your chip balance and daily-bonus state are kept in your account, and the balance our servers hold is the one that counts. Chips in an account are subject to Section 03: they cannot be bought, cashed out or transferred to another person or account, and they have no monetary value. When you sign out, your chips stay in your account, so the device shows 0 chips until you sign back in. We may correct a balance that results from an error, a bug, or abuse of the App.
Your data and your own copies. We take reasonable care to keep account data safe and available, but we do not guarantee that it will never be lost, corrupted or unavailable. You can save your own copy of your hand history at any time with the Export tool in Settings → Data. The limitations in Sections 12 through 14 apply to the account service and to any loss of account data.
Deleting your account. You can delete your account at any time in the App (Settings → Account → Delete account) or at api.pokersharpgto.com/account/delete. Deletion is permanent: once it has finished we cannot recover the deleted data. Deleting an account also deletes the Ask the Coach conversations and the shared hands you made while signed in, and the links to those shared hands stop working. An account with no sign-in and no sync for 24 months is deleted automatically. Deleting an account does not affect a Pro purchase, which stays with your app store (Section 08).
Suspension. We may suspend, limit or delete an account that we reasonably believe has been used to break these Terms, to abuse the App's limits, or to attempt unauthorized access to our systems, as described in Section 17.
PokerSharp provides GTO training content for educational purposes only. We make no guarantee that use of this App will improve your poker performance or produce any specific financial outcome.
Poker involves inherent risk and financial uncertainty. The strategies, ranges, and training scenarios provided through the App are mathematical approximations of game-theory-optimal play and do not account for the full complexity of live play, opponent tendencies, game selection, bankroll management, or other real-world factors that affect results.
You assume all risks associated with your reliance on the App's content. We expressly disclaim any responsibility for financial losses incurred at the poker table as a result of using, or acting in reliance on, this App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
Poker strategy is inherently probabilistic. GTO approximations are mathematical models, not guarantees of outcome. No poker training tool, including this App, can guarantee improved results at the poker table. You use the App's strategic content at your own discretion and risk.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WHERE LIABILITY CANNOT BE EXCLUDED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS ($10.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above exclusions and limitations apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless us and our affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices.
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and without liability to you. We also reserve the right to update these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document. Your continued use of the App following any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
We may suspend or terminate your access to the App at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, the license granted to you under Section 4 will immediately cease, and we may also suspend or delete your PokerSharp account and its data (Section 10). You may stop using the App at any time, and you may delete your PokerSharp account yourself as described in Section 10. Sections 5, 12, 13, 14, 18, and 19 shall survive termination of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Binding Arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You and we each waive the right to bring or participate in any class action, collective action, or representative proceeding. All claims must be brought solely on an individual basis.
Exceptions. Either party may bring an individual claim in small claims court if the claim qualifies. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to prevent infringement of intellectual property rights or unauthorized use of the App.
Opt-Out. You may opt out of arbitration by notifying us in writing at support@ycwdesign.com within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations freely.
PokerSharp is a skill-training tool, not a gambling platform. However, we recognize that poker is played in real-money contexts and that problem gambling is a serious concern.
